Kim Zolciak claims her kids can HEAR their father Kroy Biermann engaging 'in sexual acts' when at his home as bitter custody battle ramps up

Kim Zolciak slammed her ex-husband Kroy Biermann in a declaration in their ongoing custody case for allegedly being neglectful to their four minor children - and engaging in sexual acts with multiple partners within their earshot.

In legal documents filed Wednesday in Cobb County Superior Court in Georgia, the Real Housewives of Atlanta alum, 48, says that her kids have alerted her to multiple instances where Biermann, 40, has been shirking his parenting duties.

Biermann's bachelorhood has come under scrutiny after he was awarded custody last month, as Zolciak said in legal docs reviewed by the Daily Mail that the children have been privy to his romances 'with multiple women in recent months.'

Zolciak told the court in her filing that the children will not see their father 'for hours on end, but hearing him engage in sexual acts with his girlfriend of the moment.'

The filing marks the latest chapter in their ongoing court case determining where their children - KJ, 15, Kash, 13, and twins Kaia and Kane, 12 - reside and whom they stay with. 

The Daily Mail has reached out to representatives for both parties for further comment on the story. 

Zolciak said in the court filing that she has been 'constantly contacted by every one of the children while' they are with their father because their basic needs aren't being met.  

The Bravo star said she 'immediately ensures that the children have what they need' when they ask her 'for food because they are hungry, or medicine because they are sick.'

Biermann, a one-time regular for the NFL's Atlanta Falcons, has subjected the children 'to frightening rage-fueled tirades,' Zolciak claimed in the court filing.

Zolciak said a court-appointed guardian has repeatedly exhibited poor judgment in assessing how she and Biermann co-parent the children, routinely issuing decisions that favor their father.

'The children’s interests are not being protected,' Zolciak said, adding that the court 'is the only one who can help these children, and ensure their best interests are put front and center.

'Unfortunately, as of now, all other professionals have woefully failed these children.'

Zolciak in her recent motion claimed that a woman who had been seeing Biermann sent her new beau Kyle Mowitz a text telling him that Biermann is 'abusive.'

The text read, 'I believe Kim ... and his abuse is unlike any I've ever witnessed.'

The former reality TV couple parted ways in 2023, and had a series of breakups and reconciliations before ultimately parting ways. 

Biermann this past March asked the court in docs reviewed by the Daily Mail to grant him full custody of the minor children, accusing his ex of 'blatant mismanagement of basic parenting responsibilities' in a court filing. 

He told the court that Zolciak's conduct 'would be practically unbelievable to anyone not familiar with the circumstances.' (Zolciak denied allegations made by Biermann.)

She told the Daily Mail in a statement about the case, 'I refuse to be bullied or have lies twisted into a narrative about who I am. I will not stay silent; the truth is on my side, and it will come to light - no matter how hard anyone tries to bury it.'

Zolciak added, 'These accusations are completely false and nothing more than a deliberate attempt by Kroy to defame my character. 

'I spent five weeks away working on two TV shows to support my family and make sure my children are cared for – something I will never apologize for.' 

Zolciak and Biermann are parents to four children while Biermann adopted Zolciak's two elder daughters from prior relationship, Brielle, 29, and Ariana, 24.

Zolciak rose to fame as a member of the cast of Bravo's The Real Housewives of Atlanta, and parlayed her popularity into the spinoff Don't Be Tardy... on Bravo. She also competed on five episodes of Dancing with the Stars in 2015.

Biermann was drafted into the NFL in 2008 after attending Montana, and played eight seasons, all for the Atlanta Falcons.  

He had his most productive year on the field in 2012 when he started 14 games, racking up 36 tackles, three sacks and scoring a touchdown on an interception.

Zolciak and Biermann exchanged vows in a lavish $1 million wedding on November 11, 2011 - marking the date 11/11/11 - at their Georgia mansion.
