The sober house that Presley Gerber had stayed at before his tragic death at 27 was investigated following his suspected overdose, but no violation was found.

The late model passed away on September 20 at the rehab facility Resolutions Living, located in Santa Monica, after he had checked in the night before.

Following his death, a reform advocate with no relation to Gerber made a formal complaint regarding Resolutions Living, according to Page Six.

After receiving the complaint, the California Department of Health Care Services (DHCS) 'initiated a review solely to determine whether the program was providing any services that would require a state license,' a DHCS representative told the Daily Mail in a statement on Thursday.

After the review, the DHCS did not find any 'violations' and 'did not identify any activities that would constitute unlicensed substance use disorder treatment or otherwise require licensure.' The matter has since been closed.

The DHCS spokesperson also noted that they do not have record of the facility being listed as 'a licensed substance use disorder residential treatment facility' but that, based on public records, the program 'appears to operate as a sober living environment or recovery residence.'

After receiving a complaint about the Resolutions Living facility in Santa Monica (pictured), the California Department of Health Care Services (DHCS) 'initiated a review solely to determine whether the program was providing any services that would require a state license.' No violation was found

The representative added that those types of programs are 'not licensed, certified, or overseen by DHCS, as they are not permitted to provide alcohol or other drug treatment services requiring state licensure.'

'Sober living environments may, however, be subject to permits, clearances, business taxes, or other local requirements established by cities or counties,' the spokesperson said.

It comes not long after it was revealed that the same sober house previously had another overdose incident just seven months before Gerber's death.

Page Six reported that the advocate had requested that DHCS look into whether the rehab center was running 'beyond the lawful scope of sober living' and if the facility took in an individual who needed a 'higher level of care' than what could be offered to Gerber upon his arrival.

Two main points were also raised in the complaint including, 'Was an individual reportedly under the influence admitted to a sober living residence that was not authorized to provide the level of care he required. And was Resolutions Living actually providing regulated addiction treatment, detoxification, clinical monitoring, or recovery services beyond the lawful scope of sober housing?'

The complaint cited a previous Page Six article reporting that Gerber allegedly did not appear sober upon checking into the sober house.

'That allegation raises extremely serious questions about his admission, screening, supervision, and level-of-care determination,' the complaint said, in reference to the article.

TMZ also reported on Thursday that staff at the rehab facility have allegedly started quitting, while individuals staying at the home have been leaving.

Sources claimed to TMZ that around four employees, which include technicians and kitchen staff, have given their resignation since Gerber's passing.

Insiders alleged to the outlet that some staff have encouraged residents to leave the facility, while some have already moved out.

Sources also claimed to TMZ that 'morale' at the sober home had been declining for at least a year.

Daily Mail has reached out to reps of the Gerber family and Resolutions Living for comment, but has yet to hear back.

Earlier this week, it was revealed that the sober home where Gerber died from a suspected overdose allegedly had another overdose incident just seven months earlier.

Police reportedly responded to a call from the Resolutions Living facility about another patient who suffered an overdose on February 18, according to Santa Monica Police Department records obtained by TMZ.

The call allegedly came from someone at the Santa Monica facility who was worried that a female patient had overdosed.

The woman was found unresponsive but was eventually revived with 'upwards of 5 doses of Narcan' according to a source connected to Resolutions Living, who spoke with TMZ.

When the police arrived, it was determined that there was no need to take the patient for any further medical treatment, and officers left after speaking with the woman.

Gerber documented his final hours in a video taken at the Resolutions Living sober house, on the evening before he died of an apparent overdose; Seen 2019

Gerber, who was recently remembered in a heartwrenching tribute by his sister Kaia Gerber, documented his final hours in a video taken at the Resolutions Living sober house, on the evening before he died of an apparent overdose.

The troubled son of supermodel Cindy Crawford and businessman Rande Gerber had checked into the facility just the night before he was found dead on September 20, after going into cardiac arrest.

In footage obtained by TMZ, the model was seen giving a solo tour of the sober home while wearing a white undershirt that showed off his prominent tattoos, a silver chain necklace and a pair of black eyeglasses.

Gerber appeared visibly under the influence in the clip, taken around 10pm on Saturday night, as he stared into the camera with noticeably glazed eyes.

Throughout the video, he panned the camera around a bedroom and multiple areas of the residence. He appeared to be on his own.

Gerber reportedly 'got high' on Saturday afternoon and became concerned he was losing control, insiders previously claimed to TMZ.

His sober coach called the sober living facility and asked if he could bring Gerber in, though he made it clear that Gerber was high on drugs, sources with direct knowledge alleged to the publication.

The facility's admissions officer reportedly agreed to take him in, as per TMZ.

The sober coach had reportedly planned to take Gerber to a rehab facility the following Monday, but needed a temporary hold for the weekend and ended up leaving him at Resolutions Living, insiders claimed.

Gerber was found dead the next morning, and sources connected to Resolutions Living reportedly claimed to TMZ that the admissions officer who allowed him into the facility has since been fired.

Per TMZ, Gerber had been staying in a separate house on the grounds of the Los Angeles sober house, and had roommates.

According to the Resolutions Living website, the home is 'located in the prestigious northern section of the city, our beautiful three-story luxury property features breathtaking views of the ocean and city lights, while remaining nestled away in a safe and discreet neighborhood.'

In their mission statement, the co-ed facility aims to 'provide the structure, recreational opportunities, life skills, vocational coaching, accountability, and community necessary to support men and women in their journey to recovery from mental health, addiction, and co-occurring disorders.'

Gerber had been open about his decade-long struggle with drug addiction and mental health.

Sources described as being close to the investigation previously said Gerber had allegedly been found in a bedroom at the high-end rehab house, according to TMZ.

The insiders also alleged that Gerber's body was not on the bed, but instead was found nearby in the room, though they did not specify an exact location.

The sources additionally told the publication that the potentially deadly narcotic fentanyl has not been a focus of the investigation into Gerber's death at this time.

However, final confirmation of any substances that may have played a role in his death will have to wait until the Medical Examiner's toxicology report is released.

The Daily Mail previously obtained audio of the 911 emergency dispatch call made from the Santa Monica rehab, in which an automated voice could be heard saying 'cardiac arrest' followed by 'overdose.'

Shortly after the release of the 911 audio, sources close to the model told TMZ that a physician had been prescribing him ketamine despite knowing his past problems with the drug.

Ketamine can be used to treat drug addiction; however, that is not the use approved by the FDA.

Over the past weekend, Gerber's parents issued a joint statement shared on Instagram in which they said that they are 'beyond heartbroken' at the loss of their only son.

'We feel so blessed to have had Presley in our lives for 27 years. He is a sweet, beautiful soul who loved and is loved, now and forever. We are so proud of how he showed up in the world, with kindness and vulnerability.'

The statement continued: 'We are grateful for the outpouring of love and support from so many who know and love our family and even strangers who feel our pain. Til we meet again our sweet boy. We love you forever, Mom, Dad and Kaia.'

Kaia also shared her own tribute, posting home video footage of herself and her brother as children along with a letter in which she revealed the depths of her grief at his passing, writing, 'I am, quite literally, down on my f***ing knees.'
