Garth Brooks Hopes to Move His Sexual Assault Case to Federal Court

Brian Jordan Alvarez is speaking out on recent allegations

The English Teacher creator and star has been accused of sexually assaulting his The Gay and Wonderous Life of Caleb Gallo costar Jon Ebeling while filming the 2016 web series, according to Ebeling's police report filed Sept. 1 and obtained by E! News Dec. 17.

Ebeling made allegations in an article published by New York Magazine's Vulture Dec. 17, about two times he said that Alvarez pressured or forced sexual acts with him during their friendship, once at Ebeling's apartment and once on the set of their series, which Alvarez, 37, wrote, directed and starred in.

However, Alvarez's representatives vehemently denied the accusation, emphasizing that their interactions were "always entirely consensual—as numerous witnesses have attested."

"Indeed, in 2018, two years after this alleged incident, Mr. Ebeling himself unambiguously said as much on tape," a spokesperson for Alvarez told E! News in a statement. "For many months, Mr. Ebeling has peddled his falsehoods to anyone who would listen but, when confronted with proof of his duplicity and definitive evidence provided by third parties showing why Mr. Ebeling should not be trusted, numerous media outlets declined to print his outrageous claims."

His reps also slammed New York Magazine, which Vulture is part of, for publishing the allegations.

“Sadly, New York Magazine displayed no such judgment,” the statement said, "in its reckless headlong pursuit of publishing a salacious, attention-grabbing article, no matter the truth."

“That’s beyond disappointing and is a deeply troubling reflection on New York Magazine’s ethics—and anyone tempted to republish Mr. Ebeling’s claims should be aware of the risks involved in doing so,” it continued. “Brian is currently taking legal advice as he considers his next steps.”

E! News has reached out to Koenig’s reps and reps for New York Magazine for comment and has not heard back. E! News also reached out to LAPD for the status of the case but has not received an update.

Ebeling—who had been dating Alvarez's best friend and current English Teacher costar Stephanie Koenigalleged that one sexual encounter occurred while he and Alvarez were hanging out at his apartment in October 2015 and Ebeling felt "the insane pressure" to "hook up" with him.

Ebeling, 36, alleged Alvarez had suggested they become physically intimate, telling him he wanted to compare genital sizes and smell him. Ebeling said that he had told the comedian "no" multiple times before he allowed him to perform oral sex on him.

"I thought this is what I needed to do to keep the peace, to keep seeing Steph," he told Vulture, "to stay on the show."

Ebeling later told police he "felt coerced into the act and that he identifies his sexual orientation as heterosexual," per the September 2024 police report.

Ebeling said that experience later inspired the third episode of Caleb Gallo, in which Ebeling and Alvarez's characters hook up and subsequently tell Koenig's character about the encounter. It was while filming a sex scene for the show in January 2016 that Ebeling alleged he was sexually assaulted by Alvarez, with him saying the Will & Grace alum went under the blanket on set and began performing oral sex.

"I am assuming nobody on set knows what's going on under the comforter and I'm just frozen," Ebeling said. "I didn't know what to do. I'm on set with my director, who is assaulting me. It was a horrible feeling."

Alvarez’s rep said Ebeling “consented verbally” ahead of time, prompting Ebeling to tell Vulture that Alvarez should "produce the evidence,” adding, “No way in hell would I have ever consented to that.”

Ebeling told E! News he’s always maintained that the incident on set was assault.

Although Ebeling said he was devastated by the alleged assault, he tried to move past it.

"My work on Brian's stuff was the only thing creatively I was doing," he told Vulture. "I let the fear of losing my whole network of people win."

Ebeling added to E! News that he finds it "interesting" that Alvarez is “now willing to address the story as he has so far been unwilling to talk except through lawyers.”
