More than a week after the It Ends With Us star filed a sexual harassment and retaliation complaint against him with the California Civil Rights Department, as The New York Times reported Dec. 21, Lively has now filed a lawsuit against him, as well as a few members of his team, for mental pain and anguish, severe emotional distress, and lost wages, according to documents obtained by E! News Dec. 31.
Per the filing, in addition to Baldoni, Lively is also suing "crisis manager" Melissa Nathan and publicist Jennifer Abel, as well as his company Wayfarer Studios, which produced the movie.
Similar to Lively's complaint filed earlier this month, the lawsuit includes allegations of sexual harassment, and other alleged inappropriate behavior during filming.
The actor, among a group of 10 plaintiffs named in court documents obtained by E! News, filed a $250 million lawsuit against the New York Timesfor their published piece that focused on Lively's sexual harassment allegations.
“Notably, Lively chose not to file a lawsuit against Baldoni, Wayfarer, or any of the Plaintiffs," the complaint notes, "a choice that spared her from the scrutiny of the discovery process, including answering questions under oath and producing her communications. This decision was no accident."

Bryan Freedman, a lawyer for Baldoni and his production company Wayfarer Studios who filed the lawsuit on behalf of the plaintiffs, told E! News in a statement that the Times “cowered to the wants and whims of two powerful ‘untouchable’ Hollywood elites, disregarding journalistic practices and ethics once befitting of the revered publication by using doctored and manipulated texts and intentionally omitting texts which dispute their chosen PR narrative.”
Regarding the suit against the NYT, Lively's attorney tells E! News in a statement, "Nothing in this lawsuit changes anything about the claims advanced in Ms. Lively’s California Civil Rights Department Complaint, nor her federal complaint, filed earlier today."
"This lawsuit is based on the obviously false premise that Ms. Lively’s administrative complaint against Wayfarer and others was a ruse based on a choice 'not to file a lawsuit against Baldoni, Wayfarer,'" they continue, "and that 'litigation was never her ultimate goal.' As demonstrated by the federal complaint filed by Ms. Lively earlier today, that frame of reference for the Wayfarer lawsuit is false. While we will not litigate this matter in the press, we do encourage people to read Ms. Lively’s complaint in its entirety. We look forward to addressing each and every one of Wayfarer’s allegations in court.”
E! News has reached out The New York Times for comment on the lawsuit and has not heard back.

In Lively's original complaint filed Dec. 21 obtained by E! News, the Gossip Girl alum accused Baldoni of creating a hostile work environment on the set of theur movie It Ends With Us, also alleging that he later took part in a smear campaign against her. (For his part, Baldoni has denied the allegations.)
Lively also alleged in the documents that the environment on set escalated to a point where a meeting—attended by her husband Ryan Reynolds, among others—was held to address Baldoni's behavior.
In response, Baldoni's attorney slammed Lively's complaint as an attempt to "fix her negative reputation" and stated that it's "false, outrageous and intentionally salacious with an intent to publicly hurt."
Lively, on the other hand, told the publication in her own statement that she hoped her "legal action helps pull back the curtain on these sinister retaliatory tactics to harm people who speak up about misconduct and helps protect others who may be targeted.”
